Terms of Service
All orders for products and services in the Filpumps Web-site are accepted by Filpumps Ltd (hereby referred to as “Filpumps”) subject to these terms and conditions of sale. No other terms will apply to the supply of products and services by Filpumps or expressly stated otherwise in these terms and conditions of sale.
All descriptions of the products and services contained in the Filpumps online store or otherwise communicated are approximate only and shall not form any part of the contract between Filpumps and the Customer. Filpumps shall not be liable for any errors or omissions in the online store. The advertising of products and services in Filpumps online store is not an offer capable of acceptance, it merely constitutes an invitation by Filpumps to make an offer to purchase products and services.

SECTION 4 - TERMS OF SALEÂ You will be submitting an order for the products you indicate in the order form when you click on the place order button on the order page on the secure server. All orders will incorporate our terms of sale, by placing an order you are indicating that you agree to these terms.
SECTION 5 - ACCURACYÂFilpumps has made every reasonable endeavour to accurately detail all product descriptions, images and technical specifications. In the event of an incorrect price or product specification shown on this Site, Filpumps is not obliged to fulfil any orders placed at the incorrect price, or supply products to fulfil an incorrect product specification.
All prices stated are for new products and will be invoiced in UK Sterling (UKÂŁ/GBP) inclusive of United Kingdom Value Added Tax at the prevailing rate. Prices are subject to alteration without prior notice. Availability of any item cannot be guaranteed at all times.
Will be notified of any price changes before orders are processed and have the opportunity to cancel the order if wanted.
SECTION 7 - METHODS OF PAYMENTCustomers can make payment on the Filpumps website via Paypal. Â
SECTION 8 - ORDER ACCEPTANCEÂ You will be notified by e-mail when your order is submitted to us. A short time later you will be contacted by phone or receive another e-mail giving you an approximate delivery date. Your order will be deemed to have been accepted when payment has been received by Filpumps.Filpumps reserves the right to decline to trade with any company or person. In addition, Filpumps may decline to accept any order by giving notice of non-acceptance to the Customer by telephone or email within a reasonable period of receipt by Filpumps of the order.
SECTION 9 - ORDER CANCELLATIONCustomers have the right to cancel an on-line order from Filpumps, from the time the order is accepted by us until 7 working days after the order is fulfilled. If a customer wishes to cancel an order with Filpumps, they must contact Filpumps to make arrangements for the goods to be returned. It is the customer’s responsibility to ensure that good care is taken of the goods whilst in their possession and that they are returned to Filpumps in a condition whereby they are fit for resale and are unused. Where Filpumps organises to collect and return a product on behalf of a customer, a carriage and administration fee of not more than 35% of product value will be levied.
If order is cancelled and Filpumps are to collect goods, consumer will only be charged the direct cost of returning goods.
SECTION 10 - PRODUCT SHORTAGESIn the event that we are unable to complete an order due to unforeseen product shortages, a full refund will be provided if the payment has already been processed, or at the customer’s option the item(s) may be put on back order to be fulfilled when Filpumps next has available stock.
SECTION 11 - DELIVERYYour order will not be dispatched until we have received satisfactory authorisation of payment. Our obligation is to deliver the product to the delivery address as specified in your order, it is the customer’s responsibility to ensure adequate access for the delivery vehicle. Delivery time may be affected by the time it takes to authorise your payment. Delivery will not be possible on public holidays. We may use an independent carrier to deliver your goods.
If there is no one to accept the delivery of your order a card will be left by the carrier. It will be your responsibility to arrange a new delivery time with the carrier. Ultimately if the carrier is unable to deliver the order it will be returned to us and you will incur a further charge for it to be re-dispatched. A copy of our courier's terms and conditions can be requested.
We may deliver the products at any time during the day. In the event that any order is delayed Filpumps will not be responsible for any consequential loss or damage that this delay may cause.
We are able to deliver products to addresses in the Isle of Man, Channel Islands, the Republic of Ireland or any location outside the British Isles, however please contact us for an accurate delivery price.
We may debit your account for more than the amount stated in the total cost to reflect any increase in the delivery charge for reasons beyond our reasonable control. Any cost increase will be fair, proportionate and subject to your prior approval.
Will be notified of any increased delivery charge ASAP and have the opportunity to cancel the order if wanted.
 SECTION 13 - INSPECTIONÂThe customer must inspect the products as soon as is reasonably possible after delivery and shall, within 7 working days of the date of delivery, give notice to Filpumps detailing:
1) Any defect in the product that is apparent on reasonable examination. In this case Filpumps shall, at their own discretion, replace the products or refund their purchase price. In an event the Customer must refuse parcels delivered in a damaged condition.
2) Any shortfall in products delivered. In this case Filpumps will, at its discretion, deliver the undelivered products or refund the price of the undelivered products.
There is no set time-scale applied
SECTION 14 - RETURNS POLICYIn the event that you wish to return any items ordered from Filpumps, you must in the first instance contact Filpumps via telephone or email to be issued with a Return Merchandise Authorisation (RMA) number. This should then be marked clearly on the Form provided with the Filpumps delivery note.
Please note that the cost of return shipping is the responsibility of the Customer and Filpumps are not liable to refund the cost of any return shipping.
As with “Order Cancellation”, if you wish Filpumps to arrange to collect and return a product on your behalf, a carriage and administration fee will apply, which will not exceed 35% of the product value.
Any products returned to Filpumps without an RMA number cannot be processed and therefore a refund cannot be given.
If order is cancelled and Filpumps are to collect goods, consumer will only be charged the direct cost of returning goods.
 SECTION 15 - RISK AND OWNERSHIP  Risk of loss or damage to the products shall pass to the Customer on delivery. Ownership of the products shall not pass to the Customer until all sums due to Filpumps from the Customer for those products have been received by Filpumps (in cash or cleared funds).
SECTION 16 - WARRANTYÂ All items are guaranteed for a minimum of 12 months. Where longer guarantee periods may apply, these are provided at the discretion of the product manufacturer and not Filpumps.
This is in addition to your legal rights.
SECTION 17 - LIABILITYFilpumps shall not be under any liability for damage, losses (whether direct, indirect or consequential), expenses, liabilities, injuries, loss of profits, business or economic loss, depletion of goodwill, costs (including legal costs), claims, demands, proceedings, judgements or otherwise resulting from the failure to give advice or information or the giving of incorrect advice or information whether or not due to its negligence or that of its employees, agents or sub-contractors.
This does not affect your statutory rights.
 SECTION 18 - FORCE MAJEURE Filpumps reserves the right to defer the date of delivery or to cancel the contract or reduce the volume of the goods ordered if it is prevented from or delayed in the carrying on of its business due to circumstances beyond its reasonable control including, without limitation, acts of God, governmental actions, war or national emergency, acts of terrorism, protests, riot, civil commotion, fire, explosion, flood, epidemic, lock-outs, strikes or other labour disputes, or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials.
SECTION 19 - DATA PROTECTIONThe processing of personal data is governed by the Data Protection Act 1998, under which Filpumps is registered as a data controller. Any personal data you provide will be held securely and in accordance with the Data Protection Act 1998. We will use your personal data for the purpose(s) in relation to which you have provided it. We may however need to disclose personal data to a third party so that they can provide the service you have requested. We may additionally need to disclose information where there is a legitimate reason for disclosure (such as a court order) but we will ensure that we always comply with the Data Protection Act. Any information about you that we pass to a third party will be held securely by that party, in accordance with the Data Protection Act 1998, and used only to provide services or information you have requested.
SECTION 20 - GOVERNING LAWThese Terms and Conditions shall be governed by and construed in accordance with the laws of Scotland
